Terms and Conditions

Welcome to Brushstroke Academy Toronto. These Terms and Conditions ("Terms") govern your use of our services and website. By enrolling in our workshops or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing our website, registering for classes, or participating in our workshops, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you may not use our services.

2. Eligibility and Enrollment

2.1 Age Requirements

Students must be at least 16 years of age to enroll independently. Students under 18 must have parental or guardian consent for enrollment.

2.2 Registration

Enrollment in workshops is subject to availability. Registration is not complete until payment is received and confirmed. We reserve the right to refuse enrollment to any individual for any reason.

2.3 Prerequisites

Some workshops may have skill-level prerequisites. Students are responsible for ensuring they meet the requirements before enrolling.

3. Fees and Payment

3.1 Workshop Fees

All workshop fees are listed in Canadian Dollars (CAD) and must be paid in full before the workshop start date unless alternative payment arrangements have been made in writing.

3.2 Payment Methods

We accept payment by credit card, debit card, and e-transfer. All payments are processed securely through our payment service providers.

3.3 Late Payments

Late payments may result in suspension from classes until payment is received in full.

4. Cancellation and Refund Policy

4.1 Student Cancellations

  • More than 14 days before start date: Full refund minus $50 administrative fee
  • 7-14 days before start date: 50% refund
  • Less than 7 days before start date: No refund; credit toward future workshop
  • After workshop begins: No refund or credit

4.2 Academy Cancellations

Brushstroke Academy reserves the right to cancel any workshop due to insufficient enrollment or unforeseen circumstances. In such cases, students will receive a full refund or may transfer to another workshop.

4.3 Missed Classes

No refunds or credits are provided for missed classes due to student absence. Students may arrange to review missed material during open studio hours, subject to instructor availability.

5. Code of Conduct

All students are expected to:

  • Treat instructors, staff, and fellow students with respect and courtesy
  • Arrive on time and prepared for classes
  • Maintain a clean and safe workspace
  • Follow all safety guidelines and instructions provided by instructors
  • Refrain from disruptive behavior that interferes with the learning environment

We reserve the right to dismiss any student who violates this code of conduct without refund.

6. Health and Safety

6.1 Medical Conditions

Students must disclose any medical conditions, allergies, or physical limitations that may affect their participation in workshops. We will make reasonable accommodations where possible.

6.2 Materials and Equipment

Students must follow all safety protocols when using art materials and equipment. The academy is not liable for injuries resulting from failure to follow safety instructions.

6.3 Allergies and Sensitivities

Art materials may contain substances that could cause allergic reactions. Students with sensitivities should inform instructors before beginning workshops.

7. Intellectual Property

7.1 Student Work

Students retain ownership and copyright of artwork created during workshops. By enrolling, students grant Brushstroke Academy permission to photograph and display student work for promotional purposes unless otherwise specified in writing.

7.2 Academy Materials

All instructional materials, handouts, and course content are the property of Brushstroke Academy and may not be reproduced or distributed without written permission.

8. Photography and Media

Brushstroke Academy may photograph or video record classes for promotional, educational, and documentation purposes. Students who do not wish to be photographed must notify us in writing at the time of enrollment.

9. Liability and Indemnification

9.1 Assumption of Risk

Students acknowledge that participation in art workshops involves inherent risks, including but not limited to exposure to art materials, use of tools and equipment, and physical activity. Students participate at their own risk.

9.2 Limitation of Liability

To the fullest extent permitted by law, Brushstroke Academy, its directors, employees, and instructors shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from participation in workshops or use of our services.

9.3 Personal Property

The academy is not responsible for loss, theft, or damage to personal property brought to our facilities. Students are encouraged to secure valuables.

10. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy. By using our services, you consent to the collection and use of information as described in our Privacy Policy.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from these Terms or your use of our services shall be resolved through good faith negotiation. If resolution cannot be reached, disputes shall be submitted to binding arbitration in Toronto, Ontario.
